LivingSocial provides Reservations at participating merchant locations. If you purchase a Reservation through LivingSocial, you will be directed to schedule your Reservation for the date and time made available by the Merchant. Any scheduling restrictions, such as maximum group size or time and date availability, will be specified in the fine print of the Reservation.
The Merchant has sole responsibility for honoring any Reservation and associated discount, as well as for any of Merchant’s customer loyalty programs. Additionally, the Merchant has sole responsibility for the care and quality of all food, beverages, and services it provides to you. LivingSocial does not facilitate nor is it liable for any special requests that the Merchant may accommodate at its discretion. A Reservation may not be sold, auctioned, or bartered. LivingSocial will not provide a refund for any missed Reservation if you did not cancel or reschedule according to the Merchant's policies or the fine print. It is within the Merchant’s sole discretion to provide an alternative date and time for a dining experience after a missed Reservation.
There are several ways you can receive Deal Bucks. You can earn Deal Bucks by participating in various promotional activities and responding to certain offers (“Promotional Activity”). LivingSocial may also issue Deal Bucks to your account for refunded purchases, or for other reasons within its discretion; or you may purchase Deal Bucks in various increments on LivingSocial gift cards.
- Promotional Activity. In order to earn Deal Bucks indicated in the Promotional Activity materials, you must comply with the terms of the applicable Promotional Activity. LivingSocial may issue Deal Bucks to your account directly or provide you with a promotional code valid for a certain amount of Deal Bucks. If LivingSocial issues the Deal Bucks directly to your account and a Promotional Activity must be validated, Deal Bucks may not appear in your account for up to ten (10) business days. Promotional codes, valid for a certain amount of Deal Bucks, are governed by the terms and conditions disclosed on or distributed with the specific promotional code.
- Refunds. Deal Bucks received as a refund of the amount you pay will be added to your account by LivingSocial. Deal Bucks received as a refund of the amount you pay do not expire.
- LivingSocial Gift Cards. Deal Bucks acquired through LivingSocial gift cards are governed by the terms and conditions disclosed on or distributed with the specific gift card. Deal Bucks acquired through your use of a LivingSocial gift card may expire in accordance with applicable law.
You are responsible for ensuring that Deal Bucks you earn, purchase or are awarded as credits are added to your LivingSocial account. If you have Deal Bucks in your account, the Deal Bucks will automatically be the first form of payment applied to your future LivingSocial purchases.
LivingSocial’s Refer-a-Friend program (“RAF Program”) is a Promotional Activity by which you may earn Deal Bucks if a non-LivingSocial customer you refer becomes a LivingSocial customer and makes a qualifying purchase on the Site. You may earn up to a maximum of $100 in Deal Bucks over the lifetime of your participation across all referrals (“ Lifetime Program Limit”). In order to be eligible to earn Deal Bucks through the RAF Program, you must be eligible to accumulate and redeem Deal Bucks, maintain a LivingSocial account in good standing and be under the Lifetime Program Limit.
To participate, refer friends who are not current LivingSocial subscribers and who have never purchased a Voucher from the Site (“New User”) by sending them your personal referral link (“Unique Link”), available on the Site or provided to you as a recipient of an invite-only special offer. For a New User who accesses your Unique Link and, within the following seventy-two (72) hours (i) registers on the Site, and (ii) makes an initial purchase of a LivingSocial offer priced at ten dollars ($10) or more (“Eligible Offer”), LivingSocial will, within a reasonable amount of time, post to your account any Deal Bucks you are eligible to receive, up to the Lifetime Program Limit.
LivingSocial reserves the right at any time to modify or discontinue the RAF Program, either temporarily or permanently (or any part thereof), with or without notice. LivingSocial will not be liable to you in the event of any modification, suspension or discontinuance of the RAF Program.
In addition to Coupons offered throughout the Site generally, a portion of the Site is also dedicated to Coupons. It makes available digital and printable Coupons. All content located within this portion of the Site consists of Merchant or third party content not endorsed or recommended by LivingSocial. You understand that LivingSocial: (i) does not and cannot review the content made available on this portion of the Site; (ii) LivingSocial does not validate or guarantee any of the content made available on this portion of the Site; and (iii) LivingSocial is not a party to any transaction you make on a Merchant’s site or third party site.
LivingSocial Games is a feature within the Site that makes available to certain users the ability to play a promotional game, through which, you may receive a discount, Deal Bucks, or another stated prize. LivingSocial may prohibit your use of LivingSocial Games for any reason in its sole discretion.
From time to time, LivingSocial may offer you the opportunity to earn points by completing or participating in certain activities on the Site and potentially exchange the points for certain rewards as a type of loyalty program. There may be more than one type of program, or none at all, at any given time. Any such points and rewards will be subject to specified expiration and other terms and conditions posted on the Site, and will further be subject to cancellation by LivingSocial at any time, in its sole discretion. Accumulating points will only grant you the potential opportunity to exchange the points for specified rewards subject to terms that may change from time to time and without notice. Neither points nor any of the rewards are redeemable for cash, and they are not a form of stored value. Points and rewards: (i) are not your property, and you have no right or interest in them; and (ii) have no cash or property value. Your points and rewards are offered exclusively to you and may not be shared, sold, transferred, or assigned to any other person or entity. Notwithstanding the forgoing, when a reward has been redeemed for a third party product or service, that product or service is yours subject to any applicable third party’s terms and conditions. LivingSocial may prohibit your participation in its points programs for any reason in its sole discretion.
