EU Distance Selling Regulations.
You are entitled to cancel a Contract provided that you notify us that you wish to cancel no longer than seven (7) English working days after the day on which you receive the items to which the Contract relates (with the exception of any items which fall under the excluded product categories – see below).
To cancel a Contract, you must:
We will provide you with the return address once your RMA number has been issued.
You have a legal obligation to take reasonable care of the cancelled items whilst they are in your possession.
If you cancel your Contract after we have issued the corresponding Shipping Confirmation, you will be responsible for the cost of returning the item to us, and we strongly recommend that you return the package using a secure and traceable method i.e. Recorded/Special delivery, and retain your proof of postage receipt. Please be sure your package is insured and prepaid, and that you have packaged the cancelled items carefully.
Excluded Product Categories.
Please note that your right to cancel does not apply to items which fall into the following categories (this is without prejudice to your statutory rights):
Where you have cancelled a Contract (in full or in part), we will refund the full price you had paid for the cancelled item(s), including the LivingSocial delivery charge (if any). Please note though that, if you are cancelling only certain items under a Contract, we will not refund the LivingSocial delivery charge to the extent that that charge would have applied to the non-cancelled items. We will endeavour to process the refund due to you as soon as possible and, no later than 30 days from the day on which you gave us notice of cancellation.
In the event that an item you have purchased from LivingSocial UK Shop is faulty, not as described, or not fit for purpose (a “Fault”), please contact us at firstname.lastname@example.org with full details, including which item the Fault relates to, the date when you purchased the item from LivingSocial UK Shop and the corresponding order number, and the nature of the Fault.
As a consumer, you have legal rights in relation to goods that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office. Nothing in these terms and conditions will affect these legal rights.
Our saving calculations are based on either: (i) recommended retail price (‘RRP’), (ii) retailer’s price (‘RP’), or (iii) average online market price (‘AOMP’), as indicated.
The RRP is the recommended retail price as confirmed by the relevant manufacturer or brand. We will use this method for products with a reliable RRP.
The retailer’s price (‘RP’) is the price at which the featured product is sold on a specific retailer’s website, where that retailer is our supplier for that product. We will use this method for products where our supplier also retails that item directly to the public in the UK.
The average online market price (‘AOMP’) is the average price at which the product is sold by UK online retailers - excluding 'flash sales' sites, and private sellers (for instance via eBay). The calculation is based on the results for the first 30 organic search listings, and the sponsored search listings featured on the first three pages of search results, returned against a Google UK web search against the full product name (selecting to view only ‘pages from the UK’), carried out no longer than two weeks before we publish the deal. We will use this method when no RRP is given, and where our supplier does not also retail that item directly to the public in the UK.
If we are not referencing a saving, the foregoing does not apply.
