LivingSocial’s Takeout & Delivery Service
Terms and Conditions
Similar to our regular Deals, Vouchers for Takeout & Delivery are time-limited promotional vouchers exchangeable for Merchant menu items (the “Takeout & Delivery Voucher”). LivingSocial’s Takeout & Delivery service allows you to order food instantly and either pick the food up yourself or have it delivered if you don’t want to go to the Merchant location to redeem your Takeout & Delivery Voucher. Once an order has been confirmed, it is transmitted to the Merchant for fulfillment and is either picked up by the purchaser or delivered by the Merchant to the purchaser. You will use your Takeout & Delivery voucher to redeem your meal. Takeout & Delivery Vouchers may only be used for Takeout & Delivery orders on LivingSocial. Takeout & Delivery orders can be made online at LivingSocial or through LivingSocial applications available on mobile devices such as an iPhone or Android.
Takeout & Delivery Deal Terms vary from the standard Deal Terms as follows:
Gratuity Not Included; No refunds: Gratuity is not included in the delivery fee and should be paid directly to the Merchant under their payment acceptance policy. Takeout & Delivery Vouchers cannot be used towards gratuity. Once a Takeout & Delivery order has been placed, it is non-cancelable. There are no refunds. All sales are final.
Takeout & Delivery Voucher Must Be Used for a Single Order; Takeout & Delivery Vouchers Cannot Be Used for Taxes: The entire value of the Takeout & Delivery Voucher must be used in a single Takeout & Delivery order, and may not be used over multiple orders. Takeout & Delivery Vouchers may not be used towards applicable taxes.
Merchant is Responsible for the Goods and Services: The Merchant is solely responsible for the all goods and services it provides to you and for any and all injuries, illnesses, damages, claims, liabilities and costs it may cause you to suffer directly or indirectly in full or in part whether related to its service or menu items.
